This site follows up on Jay M. Feinman, UN-MAKING LAW: THE CONSERVATIVE CAMPAIGN TO ROLL BACK THE COMMON LAW (Beacon Press, 2004). (For more information on the book, click here.) The book describes how the common law evolved through the twentieth century to become more flexible and to take more account of the interests of consumers, workers, and the less powerful. Over the last twenty-five years, however, conservatives have embarked on a campaign to turn back the clock on these progressive developments and produce a more rigid and business-friendly body of law.
